Terms of Service

TLDR: we migrate your site from WordPress to Astro, you judge the free homepage preview before paying anything, and once your migration is paid in full the code and its repository are yours — with two months of support while you find your footing.

Who we are

Ditchplugins, Inc. ("Ditch Plugins", "we", "us") is a Delaware corporation that migrates websites from WordPress to Astro. These terms govern your use of ditchplugins.com and any migration work you order from us. By booking a call, submitting the migration form, or ordering a migration, you agree to them.

If you are agreeing on behalf of a company, you confirm you have the authority to bind it.

What we do

We rebuild your existing, publicly available website in Astro — same design, same content, your technical SEO (redirects, schema, internal linking) preserved and improved where we see room. We work only from what is live and from assets you send us directly; we never ask for your WordPress credentials.

We migrate marketing and content sites of up to 200 pages at our flat rate. E-commerce sites and sites with logins, registration, user accounts, membership areas, or a complex backend are out of scope — we don't migrate those. Larger sites are quoted individually.

We do help migrate tracking scripts and automations (analytics, form submissions, and the like). Where an automation requires a custom backend, we don't guarantee it — we review those case by case and tell you up front what we can and can't carry over.

The free homepage preview

If your site is a fit, we rebuild your homepage in Astro for free, before you pay anything. The preview exists so you can judge our work by the result — it is not a free deliverable. Until you order the full migration and pay in full, the preview and its code remain our property, and you may not copy, publish, or reuse it. If you decide not to proceed, no charge, no hard feelings — and no rights to the preview.

Payment

The full migration is invoiced in two halves: 50% once you approve the homepage preview, and 50% on delivery, once you have reviewed the finished site. We start on the full site as soon as your first payment reaches us. Prices exclude applicable taxes.

The final 50% is due within 7 days of your approving the finished site. Until it's paid in full, nothing transfers — the code stays in our repository and the site doesn't go live.

Because the free preview lets you judge our work before committing, payments are non-refundable once the corresponding work has started: if you call off the migration after we've begun, what you've paid covers the work done to that point. The one exception is us — if we fail to deliver your migration, we refund your deposit in full, so you never pay for a site you didn't get.

Delivery & ownership

During the build, your site lives in a private GitHub repository we set up and manage. On receipt of final payment, we transfer the repository and assign to you all rights in the code we wrote for your migration — it becomes yours to host, change, and control. Your own content and assets were always yours.

We retain a license to describe the project and show the finished site in our portfolio and marketing (a screenshot, a link, before/after metrics). If you would rather we didn't, tell us before delivery and we will agree what, if anything, we may show.

Open-source components (Astro itself, libraries) remain under their own licenses.

2-month support

For two months after handover, if something breaks because of a change we made during the migration, we fix it for free. Support covers our work — it does not cover new pages, features, or design changes (fresh work, quoted separately), or problems arising after you make significant structural changes to the site yourself. By significant structural changes we mean reworking the code, adding new dependencies or integrations, or changing how the site is built — not the everyday editing and publishing we teach you in onboarding, which never affects your support.

The portfolio draw

From time to time we migrate a selected site free of charge in exchange for the right to feature it in our portfolio, and possibly a testimonial. Entering the draw costs nothing and does not obligate either of us; selection is at our sole discretion and we reply to every entry either way. If selected, the same terms apply as a paid migration, except: the price is $0, the portfolio license in section 05 is a condition of the deal and cannot be withdrawn, and we may schedule the work around paying projects.

Responsibilities & indemnities

You confirm that you own or have the rights to the website, content, and assets you ask us to migrate, and that nothing in them is unlawful or infringes anyone else's rights. You are responsible for reviewing the delivered site before approving it, and for your site's content, legal compliance, and operation after handover.

Each of us stands behind what we bring to the migration. If a third party brings a claim against one of us because of the other's contribution, that other covers the reasonable legal costs and any damages: you cover us for claims that the content or assets you gave us infringe someone's rights or break the law, and we cover you for claims that the code we wrote infringes someone else's intellectual property. Neither of us is on the hook for a claim caused by the other's own changes to the site after handover.

Warranties & liability

We promise to perform the migration with reasonable skill and care. Beyond that, the site and our services are provided "as is": we do not guarantee specific search rankings, Core Web Vitals scores, traffic, or business results — the web changes, and much of it is outside our control. Certain website setups (heavy embeds, third-party scripts, large media) may stand in the way of perfect Core Web Vitals scores — we'll do our best to improve them within the migration, and advise you on what you could change to improve them further if you wish.

To the fullest extent the law allows, our total liability for anything arising out of a migration is capped at the amount you paid us for it, and neither of us is liable to the other for indirect or consequential losses (lost profits, lost data, lost business). Nothing in these terms excludes liability that cannot legally be excluded.

Termination

Either of us can end a project by written notice if the other materially breaches these terms and does not fix it within 14 days. If a project ends early, you pay for work completed to that point; anything not yet paid for stays ours. We may decline or discontinue work that turns out to involve unlawful content or misrepresented rights.

Governing law & disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute that we cannot resolve between us will be brought exclusively in the state or federal courts located in Delaware, and both of us consent to their jurisdiction. But please — email us first. Almost everything can be sorted out with a conversation.

Changes to these terms

If we change these terms, we'll update the date at the top. Changes do not apply retroactively to a migration already in progress — the terms in force when you ordered it are the ones that govern it. For significant changes affecting an active project, we'll email you directly.
